Brownton City Council Meeting
August 4, 2020

Mayor Schwarze called the meeting to order.

Motion by Council Member Block, seconded by Council Member Messner and carried to approve the consent agenda as follows: Approve minutes of regular meeting 7/7/2020 and special meeting 7/17/2020. Approve August Treasurers Report. Approve payment of the claims and payroll including check numbers 42670-42796 in the amount of $305,611.36. Approve new bills written/to be written. 2020 – 066

John Rodeberg from SEH, Inc. discussed open projects. We will be sending the R&R final check out soon. The sewer issue on 9th has been forwarded to R&R. MR Paving will redo some areas when they come back next fall. The Attorney is reviewing the 2020 Project contracts and Chris will schedule a pre-construction meeting in the next 2 weeks. The water meter quotes are due to the Clerk by August 20th. It should take 3-4 weeks to install. Dollar General is moving along. Decisions on the electric need to be made soon.

BE IT RESOLVED by the City Council of Brownton, to approve change order #1 in the amount $17,423.68 to MR Paving and Excavating, Inc. for the additional work done on 1st Ave S and gate valve boxes on 4th St S.

BE IT RESOLVED by the City Council of Brownton, to approve pay application #2 in the amount $108,943.71 to MR Paving and Excavating, Inc. for the work completed thru July 24th, 2020.

Council is looking at creating an ordinance that would require home owners to have sanitary sewers televised before selling. The Clerk and SEH is working on this. Along with the ordinance addition, is a storm sewer base fee charge. It would be used to cover a portion of the 2018 Street Project. Some of that project cost could be levied too. This is based on usage and also acreage.

Public Works reported Carsen’s last day is August 13th and are trying to get trees trimmed by then. The lift station plugged again with rags. A new all-weather sampler is on order. Hydrant flushing August 13-14. Quade changed out 2 poles last week that were rotten. Monthly training has started again.

Chief Bauer’s report was submitted. Westphal’s blight issue was discussed and it was decided to give them 14 days to clean up all items addressed in a letter or a state citation will be issued.

Tiered natural gas for commercial was discussed.
BE IT RESOLVED by the City Council of Brownton, to approve the tiered natural gas rate as presented and include it on the fee schedule.

Ordinance amending ordinance #88-admininstrative alternate for violations of city ordinance and petty misdemeanors
BE IT RESOLVED by the City Council of Brownton, to approve amending ordinance #88 with the changes that adjust the barking dog fines to $50, blight base fines to $50 and littering ordinance to #4.

Ordinance amending ordinance #66-Zoning ordinance-discussed how big is too big and would it help the City control it.
BE IT RESOLVED by the City Council of Brownton, to approve amending ordinance #66 with the change to Section (2.01)(A)(1) to reduce the size from 200 square feet to 120 square feet for accessory buildings.

BE IT RESOLVED by the City Council of Brownton, to approve the request for proposal from Oberloh & Oberloh from Redwood Falls for our auditor for 2020-2022 as priced in their proposal.

Special Thank You to the Brownton Lion’s Club for your on-going donations to the City in the amount of $7,000!

BE IT RESOLVED by the City Council of Brownton, to graciously accept the $7,000 donation from the Brownton Lion’s Club, which will be spent on Softball Fields, Summer Enrichment, and Summer Recreation.

The League called to discuss the old school building. It was decided to file a claim with our insurance and see if we can get some help from them on the demolition.

BE IT RESOLVED by the City Council of Brownton, to approve the addition of the Face Coverings section in the Preparedness Plan originally approved on June 29, 2020.

RESOLUTION WAIVING PROVISIONS OF ORDINANCE #49

BE IT RESOLVED by the Brownton City Council to waive the provisions in Section 2 of Ordinance # 49, “An Ordinance Prohibiting the Consumption of Intoxicating Liquor and Non-Intoxicating Liquor within the City of Brownton” rescheduled from Saturday July 25, 2020 and moved to Saturday August 8, 2020.
BE IT FURTHER RESOLVED that this waiver pertains to the following locations: Fourth Avenue North between Division Street and Second Street North to accommodate the street dance for the Brownton Bar & Grill.
