Council denies petition to vacate alleyway on technical error

The Silver Lake City Council denied a petition to vacate the alleyway running east-west between Oliver Avenue and Nome Avenue and between Center Street and Frank Street during a public hearing Monday evening. 
Ryan and Kari Kaczmarek, owners of a lot adjacent to the alleyway, proposed the petition in hopes of purchasing the lot to be able to add on to their house.
“My family kind of outgrew the house and we wanted to stay living in town here,” Ryan Kaczmarek said. 
The petition had to be signed by a majority of property owners with lots abutting the alleyway. The four lots adjacent to the alleyway are owned by the Kaczmareks, George Jones and brothers  Brian and Todd Urban.
The petition was signed by Jones and Ryan Kaczmarek, and the Urbans objected to the petition because of water drainage issues.
“I think there are way too much water problems coming down from the alley. There are issues of water drainage and nobody has ideas what to do about it,” Brian Urban said.
He said the alley is “set up to take water down” and commented that his garage at the end of the alleyway gets flooded and felt that if the Kaczmareks build upon the alleyway, “we’re going to take the brunt of the water (coming off their house.)
