Minutes 9/7/2021

Commissioners Nagel, Wright, Krueger, Luthens and Schmalz were present
County Administrator, Sheila Murphy, requested to remove items 7A and 7B from the agenda. Wright moved, Schmalz seconded and motion carried unanimously to approve the agenda as revised.
Nagel moved, Schmalz seconded and motion carried unanimously to approve the consent agenda. Consent agenda items included: (a) August 17, 2021 County Board Meeting Minutes; (b) August 13, 2021 Auditor’s Warrants; (c) August 20, 2021 Auditor’s Warrants; (d) August 27, 2021 Auditor’s Warrants; (e) Renewal of County’s curtailment maintenance agreement with Utility Energy Sys\ tems (Elk River, Minnesota) for annual maintenance and training on the curtailment system located at the Courthouse for an annual fee of $2,033.00 with funding from the Courthouse Maintenance budget (01-111); (f) Approve the sale of a 2010 Ford Escape 1FMCU0C78AKC90077
through Fahey Sales; (g) Approve revision of previously approved Belle Lake Association Aquatic Invasive Species (AIS) Program 2021 for distribution of AIS Grant Funds from $10,842.30 to $12,477.45; (h) Approve Conditional Use Permit 21-16 application by Brian Roushar to construct an accessory building to be greater than 2,400 square feet on a parcel that is less than 10 acres in size to be used for personal use only; (i) Approve 1- lot Preliminary Plat application by Jon and Mandi Kutschara on non-tillable acreage (grassy area) on
property they own to be known as “KUTSCHARA ACRES” in order to create one additional building site; (j) Approve an extension to file a 1-Lot preliminary/Final Plat application by Brad Johnson to be known as TYKAY ADDITION until October 30, 2021, due to consent to plat delays; (k) Approve license agreements and terms of service with Apple and Google for publishing mobile apps in their App Stores and authorize IT Manager Matt Troska to execute the agreements; (l)
Approve final acceptance and payment of $9,945.87 to Duininck, Inc. (Prinsburg, Minnesota) for County Project (CP) 20-000-03, rehabilitation project on County State Aid Highways 5 and 16 north of Silver Lake. Schmalz moved, Luthens seconded and motion carried unanimously to approve the services of Streamworks (Blaine, Minnesota) for the processing of Truth in Taxation (TNT) notices,
tax statements and valuation notices for an estimated cost of $13,754.00 with funds from the Auditor-Treasurer budget (01-041).
Nagel moved, Luthens seconded and motion carried 4-1 to join the Belle Lake Association on an ongoing basis for a cost of $50.00 per year with funds from the County Parks budget (01-520). Roll call: Luthens – yes; Wright –yes; Krueger – no; Nagel – yes; Schmalz – yes.
Schmalz moved, Luthens seconded and motion carried unanimously to hire Erickson Engineering (Eden Prairie, Minnesota) for design engineering services for rehabilitation of
bridge 43515 on County Road (CR) 71 near the Spruce Ridge landfill for an estimated total fee of $8,900.00 with funds from the Highway Construction budget (03-320).
Schmalz moved, Nagel seconded and motion carried unanimously to approve Temporary Permits to Construct
for Minnesota Department of Transportation (MnDOT) construction project SP 4307-47, Americans with Disabilities Act (ADA) improvements along Trunk Highway (TH) 22 in Glencoe.
Nagel moved, Luthens seconded and motion carried unanimously to sell 0.078 acres of County property along TH 22, across from the Government
Center, and the associated Temporary Permit to Construct for MNDOT construction project SP 4307-47, ADA improvements along TH 22 in Glencoe for a cost of $3,700.00; contingent upon the County retaining one access point to TH 22.
Wright moved, Krueger seconded and motion carried 3-2 to approve Conditional use Permit 21-14 application by Scott Tempel, on behalf of NovelEnergy Solutions (Saint Paul,
Minnesota), for Essential Services of a one-megawatt community solar garden array system for the purpose of electrical generation through solar energy inter- connected to an Xcel Energy substation with, conditions. Nagel moved, Luthens seconded and motion carried unanimously to approve Conditional Use Permit 21-14
application by Scott Tempel, on behalf of Novel Energy Solutions (Saint Paul, Minnesota), for Essential Services of a one- megawatt community solar garden array system for electrical generation through solar energy with conditions.
Nagel moved, Wright seconded and motion carried 4-1 to accept the proposed essential service amendments to the current McLeod County Zoning ordinance, Section 5, Section 7 and Section 17. The amended setback distance from a dwelling to the solar array project area of 330’ was included in this motion. Roll Call: Luthens – no; Wright – yes; Krueger – yes; Nagel – yes;
Schmalz – yes. Nagel moved, Krueger
seconded and motion carried unanimously to renew the County Administrator Employment Agreement with Sheila Murphy. Schmalz moved, Nagel seconded and motion carried
unanimously to adopt Resolution
21-CB-27. Schmalz moved, Luthens
seconded and motion carried unanimously to recess at 11:46 a.m. until the next County Board Meeting on September 20, 2021 at 9:00 a.m. at the McLeod County Government Center, 520 Chandler Avenue North, Glencoe,
Minnesota.
