THIS SUMMONS IS DIRECTED TO THE UNKNOWN HEIRS OF HELEN A. Reinert.
1. YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff’s Complaint against you is on file in the office of the Court Administrator of the above-named Court. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons.
2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at: The Academy Law Group, P.A., The Academy Professional Building, 25 dD ale Street North, St. Paul, MN 55102.
3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.
4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief request in the Complaint.
5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.
6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.
7. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO PROPERTY located in McLeod County, State of Minnesota, legally described as follows.
THAT PART of Lots 16, 17 and 18 of Auditor’s Plat of the South One Half of Section 8, Township 116 North, Range 29 West of the 5th Principal Meridian, McLeod County, Minnesota described as follows: Beginning at the northeast corner of Lot 17 of said Auditor’s Plat; thence North 88 degrees 30 minutes West along the north line of said Auditor’s Plat for 514.5 feet; thence South 47 degrees 40 minutes West for 530.7 feet to a point on the easterly 75 foot right-of-way line of Minnesota Trunk Highway No. 22, thence South 47 degrees 40 minutes East along said right-of-way line 709.65 feet, thence deflect left at an angle of 90 degrees 00 minutes for 150.00 feet; thence deflect right at an angle of 90 degrees 00 minutes for 180.00 feet; thence deflect left at an angle of 90 degrees 00 minutes for 45.4 feet; thence deflect right at an angle of 90 degrees 00 minutes for 135.4 feet to a point on the east line of Lot 16, Auditor’s Plat, thence northerly along said east line of Lot 16 of Auditor’s Plat and along the east line of Lot 17 of said Auditor’s Plat to the point of beginning;
WHICH LIES southeasterly of a line described as follows: Commencing at the intersection of the east line of the Northwest Quarter of the Southeast Quarter of Section 8, Township 116 North Range 29 West with the northeasterly line of Minnesota Department of Transportation Right of Way Plat No. 43-7; thence northwesterly, along said northeasterly line of said Minnesota Department of Transportation Right of Way Plat No. 43-7, a distance of 473.85 feet to the point of beginning of said line; thence northeasterly, deflecting to the right 90 degrees 00 minutes 00 seconds to the east line of said Lot 17 and said line there terminating,
McLeod County, Minnesota.
That Plaintiff seeks an Order, pursuant to Minn. Stat. §§ 555.01 and 559.01:
1.Reforming the legal description contained in Quit Claim Deed Document No. 301053, Mortgage Document No. A-382814, Sheriff’s Certificate of Foreclosure Sale Document No. 424620, Assignment of Sheriff’s Certificate of Sale Document No. A424852, and Quit Claim Deed Document No. A432734 to incorporate the correct and complete legal description of the subject real property as referenced on Exhibit 1 herein.
2. Establishing an easement by necessity/implied easement for the purpose of ingress and egress over and across Tax Parcels 06.077.0010 and 06.070.0040.
