NOTICE TO: Alicia Jill Cardinal, legal custodian or parent of the child.
ATTENTION
1. A Petition to Terminate Parental Rights has been filed with the Sibley County District Court, alleging among other things that the parental rights of the above-named parents or legal custodians to a minor child born on 09/16/2008 should be terminated upon the grounds stated in the Petition filed in the Sibley County District Court, 400 Court Avenue, Gaylord, Minnesota, and asking for an Order of the Court terminating such parental rights.
2. Alicia Jill Cardinal, biological mother of the minor child please take notice that the Petition to Terminate Parental Rights is seeking to terminate your parental rights to the minor child.
3. THEREFORE, notice is hereby given that a continued Admit/Deny Hearing for yourself and a Pretrial Hearing in regard to said Petition to Terminate Parental Rights shall be held on October 4, 2021, at 1:00 p.m., at the Sibley County Courthouse, 400 Court Avenue, Gaylord, Minnesota. The purpose of said Hearing is to proceed with the County’s Petition to terminate the parental rights of Alicia Jill Cardinal and Christopher Brian Severin to the minor child.
4. You, Alicia Jill Cardinal, have a right to be represented by counsel in this matter.
5. Your presence is required. If you fail to appear at the Sibley County Courthouse on October 4, 2021, at 1:00 p.m., the Court may still conduct the Hearing in your absence and grant appropriate relief, including the permanent and involuntary termination of your parental rights to the minor child; the permanent transfer of the child’s legal and physical custody to a relative; a finding that the statutory grounds set forth in the Petition have been proved; and/or an Order granting the relief requested.
6. Pursuant to Rule 18 of the Minnesota Rules of Juvenile Protection Procedure, except as otherwise provided in Rules 47.02, subd. 1, and 56.02, subd. 1, if a parent, legal custodian, or Indian custodian fails to appear for an Admit/Deny Hearing, a Pretrial Hearing, or a Trial after being properly served with a Summons pursuant to Rule 44.02 or 53.02, or a notice pursuant to Rule 44.03, 44.04, 53.03, or 53.04, the court may receive evidence in support of the Petition or reschedule the Hearing. If the Petition is proved by the applicable standard of proof, the Court may enter an order granting the relief sought in the Petition as to that parent, legal custodian, or Indian custodian.
