Board of Commissioners Meeting Minutes 5/8/18
Commissioners Nagel, Pohlmeier, Krueger, Wright and Shimanski were present.
Krueger/Pohlmeier motion carried unanimously to approve the agenda as revised.
Wright/Krueger motion approved the consent agenda including April 17, 2018 Meeting Minutes and Synopsis; April 11, 2018 Auditor's Warrants; April 13, 2018 Auditor's Warrants; April 20, 2018; April 30, 2018 Auditor's Warrants; Approve application and permit for a 2 day temporary on-sale liquor license for Hutchinson Center for the Arts for the Minnesota Pottery Festival for their event being held on July 28-29, 2018 on the grounds of Clay Coyote Pottery & Gallery, 17614 240th St., Hutchinson, MN. Approve an agreement with the City of Silver Lake for the leasing of one laptop computer over a 4 year period. 4 yearly payments of $980 for the computer and $420 for the air card will be received from the City. This will allow the Silver Lake Police Department to continue with access to the Sheriff’s Office mobile computing and records management system. Approve allocation of payment from the County Recorder's Compliance fund for the purchase of a desktop computer for the Environmental Technician in the amount of $577. The County Recorder reviewed this request and recommended approval for payment to be allocated out of the County Recorder's Compliance Fund. May 8, 2018 County Board Meeting; Re-adopt the Minnesota Merit System Affirmative Action Equal Employment Opportunity (AA/EEO) Guidelines for 2018-2019 for McLeod Social Service Center. Re-appoint the Human Service Director as Liaison between McLeod Social Service Center and the Minnesota Department of Human Services Office of Equal Employment Opportunity. Approve request from Brian Gatz of Final Plat 18-01 to create a 1-Lot Plat to be known as "OAK CREEK" in the SW ¼ SW ¼ on a 10.44 acre parcel in the Agricultural District of Section 11 in Bergen Township. The Sketch Plan and Preliminary Plat have both been approved. The Board of Bergen Township recommended approval on March 9, 2018. The Planning Advisory Committee recommended approval on April 25, 2018. Approve request from Litzau Excavating, Inc. of Conditional Use Permit 18-05 to continue gravel mining and excavation with stockpiling of material on property owned by Orville Foust. This is simply a renewal of an existing 5 year gravel mining permit. A majority of the restoration has been done and is for wildlife purposes and to be located within approximately less than 5 acres of a 20 acre tract within the N ½ of the NE ¼ within Section 12 in Bergen Township. The Bergen Township Board unanimously recommended approval on March 14, 2018. The Planning Advisory Committee unanimously recommended approval at their regular meeting on April 25, 2018 with the following conditions: 1. A letter of credit or bond in the amount of $5,000.00 for pit reclamation shall be submitted to the Zoning Office prior to any mining being performed. 2. A bond shall be submitted to the Zoning Office for a minimum of $5,000.00 for road repairs during mining operation. 3. The hours of operation shall be 6:00 A.M to 8:00 P.M., Monday - Friday; Saturday from 7 A.M. to 12:00 P.M. 4. All MPCA permits shall be maintained.
5. No wetland or floodplain impacts shall take place unless prior approval from any agency with jurisdiction.
6. There shall be no stockpiling within floodplain areas. 7. Applicant shall adhere to noxious weed control measures. 8. Applicant shall adhere to proper dust control measures. 9. Follow restoration plan with back sloping at a 4:l grade 10. Applicant shall notify Zoning Office as restoration takes place so an inspection can be made; Approve request from Jeremy and Mary Otto of Conditional Use Permit 18-06 to construct an addition, (32' X 48') onto an existing accessory structure that is approximately 2,400 sq. ft. for a total of 3,936 sq. ft. on a parcel less than 10 acres in size within the Agricultural District, Section 3 in Bergen Township. The Bergen Township Board unanimously recommended approval on April 11, 2018. The Planning Advisory Committee unanimously recommended approval at their regular meeting on April 25, 2018.
Shimanski/Pohlmeier motion carried unanimously to approve payment of bills totaling $89,014.94 from the aforementioned funds
Wright/Pohlmeier motion carried unanimously to award bid for CP 17-054-001 & CP 18-062-001, cement stabilization/chip seal projects on County Road 54 (Tagus Ave) to Allstates Pavement Recycling/Stabilization (Rogers, MN) for a cost of $395,497.86. This cost does not include micro milling of the 2016 project, that work was previously approved on 4/3/2018.
Krueger/Shimanski motion carried unanimously to adopt Resolution 18-CB-18 to establish the McLeod County Ballot Board.
Nagel/Pohlmeier motion carried unanimously to enter into a contract for legal services with Motley Rice LLC, Attorneys at Law, 401 9th St NW, Washington, DC regarding opioid litigation.
Wright/Pohlmeier motion carried unanimously to hire a Communications and Compliance Specialist (Grade 160). This is a newly added position , following the long-term planning goals for the Human Resources staff in Administration
Nagel/Shimanski motion carried unanimously to hire a Jail Administrator (Grade 190) due to vacancy and approval to hire replacement.
Pohlmeier/Shimanski motion carried unanimously to approve contract for Transportation Reimbursement with NEMT (Non-Emergency Medical Transportation).
Krueger/Pohlmeier motion carried unanimously to approve contract for Transportation Reimbursement with our NEMT (Non-Emergency Medical Transportation) provider CCT Transit-Willmar.
Shimanski/Krueger motion carried unanimously to approve contract for Transportation Reimbursement with our NEMT (Non-Emergency Medical Transportation) provider ACC Midwest Transportation-Hutchinson.
Krueger/Wright motion carried unanimously to approve the remodel of the old jail kitchen into an employee break room by Bauer Companies (Brownton, MN) at a cost not to exceed $24,000.
Pohlmeier/Wright Motion carried unanimously to recess at 10:02 a.m., until 9:00 a.m. May 21, 2018 at the Courthouse Boardroom.
